The basic thing I have learned from everything I have read from copyright issues is you can use a copyrighted name as long as you use that name in other way very different from the original copyrighted word. For example the word "Apple" is the copyrighted name for a company that produces computers and electronic devices, someone can copyright the name "Apple" (given it is a generic word) to create a company that produces stationary paper and notebooks and since they both are in different business then the second "Apple" can legally copyright this business name.
Obviously there are a lot of ramifications for these actions which only copyright lawyers understand and generally when copyright based sues arise, tribunals decide in a case by case basis, regularly not every case is similar to other.
Metamorpho is not only a DC Comics character but it is also the name of a character from the collection "Outer Space Men" also known as "Colorform Aliens" produced by Four Horsemen Studios. These figures are the revival of a series of toys of the same name released in 1968, formed by seven figures, each representing an alien from one of the planets of our solar system.
The resurrection of this toy line made possible the insertion of more figures as a continuation of the 60's line but this collection is considered a niche cult series since manufacturing has been very limited as the production has moved from limited edition to limited edition, every edition tied to conventions and other special features.
Metamorpho is not the only name associated to superheroes this collection took to its characters, coincidentally there is a figure called Cyclops and another called Colossus Rex. I say coincidentally, because I honestly doubt the author was thinking about superheroes when he named these other two but instead these characters resemble their counterparts from the Greek mythology.
In this collection, Metamorpho is the man from Alpha Centauri, an alien who explores the vast universe, possessor of the ability to transform himself at will into any spacial race, copying the physiognomy of the inhabitants of the worlds he visits so he may live unnoticed among them. The action figure comes with a purple knob on its head to switch from one face to another, three faces in total.
Well, he only can change his face but OUR Metamorpho, ah! our Metamorpho, that is a true Metamorpho.
